These Terms of Service ("Terms") govern your access to and use of the website, payment terminals, and related services provided by I-Link POS Solutions ("I-Link", "we", "us" or "our"). By using our website or services, you agree to these Terms.

1. Agreement to terms

If you do not agree with these Terms, please do not use our website or services. We may update these Terms from time to time; continued use after changes means you accept the revised Terms.

2. Our services

I-Link provides payment terminals (including Clover, PAX, Newland and Ingenico devices), payment processing and related support. Specific features, availability and pricing may vary and are described at the time of your quote or agreement.

3. Eligibility & accounts

You must be a business (or authorised representative) able to enter into a binding contract. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of any account credentials.

4. Hardware & terminals

Terminals may be sold, leased or provided as part of a plan. Ownership, warranty and return terms are set out in your specific order or agreement. You agree to use devices in accordance with manufacturer and card-network guidelines.

5. Payments, fees & billing

Fees for hardware, plans and processing are described in your quote or agreement. You authorise us and our partners to charge applicable fees. Unless stated otherwise, fees are exclusive of taxes, which are your responsibility.

6. Acceptable use

• Do not use our services for unlawful, fraudulent or prohibited transactions;
• Do not attempt to interfere with, reverse-engineer or damage our systems or devices;
• Comply with all applicable laws, card-network rules and PCI requirements.

7. Third-party services & payment networks

Payment processing relies on third-party acquirers, processors and card networks that have their own terms. We are not responsible for outages, decisions or actions of those third parties beyond our reasonable control.

8. Intellectual property

The website, branding, content and software are owned by I-Link or its licensors and are protected by law. You may not copy, modify or distribute them without permission.

9. Disclaimers

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, I-Link will not be liable for indirect, incidental, special or consequential damages, or for lost profits or revenue, arising from your use of our website or services.

11. Indemnification

You agree to indemnify and hold I-Link harmless from claims, losses or expenses arising out of your breach of these Terms or misuse of our services.

12. Termination

We may suspend or terminate access to our website or services if these Terms are violated. Provisions that by their nature should survive termination will continue to apply.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

We may revise these Terms at any time. The "Last updated" date above reflects the latest version, and material changes will be posted on this page.
